Defamatory and Abusive Google Reviews: Removal Through Legal Channels

Defamatory and Abusive Google Reviews: Removal Through Legal Channels

Most negative Google reviews are opinions, and opinions cannot be sued away. But some cross a line: they assert false facts (“they stole my deposit”), insult a named employee, or repeat the same abuse from new accounts week after week. For a defamatory Google review or sustained Google review harassment, the question becomes what the law allows. This guide explains how to remove a Google review legally: why the policy route still comes first, which evidence a court accepts, how court orders work in Germany and Austria, when the GDPR right to erasure applies, how Law 5651 works in Türkiye, and what no provider can promise.

Opinion or defamation: where the line runs

Every legal system that protects free speech distinguishes between a value judgement and a statement of fact. A value judgement (“worst hotel of my life”) is protected even when it is harsh. A statement of fact can be proven true or false, and a false one that damages reputation is defamation. Insults and threats form a third group that is unlawful regardless of truth in most jurisdictions.

In practice: “Overpriced, rude staff, never again” is an opinion and can only be answered. “They charged my card twice and refused to refund” is a statement of fact that payment records can disprove. “The receptionist Ayşe is a thief and a liar” is an insult and an accusation against a named person, which opens the harassment policy, the GDPR and a criminal complaint. The first kind is the one owners most often want removed and the one no route can touch.

Step one is always the Google policy route

Even in the clearest defamation case, report the review through Google first. It is free, it takes 3 to 21 days, and Google’s content policies already prohibit harassment, hate speech, threats, personal information and fake engagement. A review calling a named employee a thief is removed under the harassment policy far faster than any court can act. As the verified owner, open Google Business Profile, go to Manage reviews, choose Report a new review for removal, select the matching policy and quote the exact words. If rejected, appeal once with evidence; for cases handled by yorumkaldir.com the decision appears in your live report link.

Google’s legal removal form

Separate from the policy tool, Google runs a legal removal request process (“Report content for legal reasons”) for defamation, privacy and court-order requests. Outside the EU, Google usually asks for a court order before acting on a defamation claim; inside the EU, the Digital Services Act obliges it to assess a precise notice of illegal content and give reasons. Keep every reference number.

The policy route is where yorumkaldir.com works, and it works without prepayment: the fee applies per review actually removed by Google, after the work. If a review needs a legal route instead, we say so before anything is billed.

Evidence: build the file before you do anything else

Reviews get edited and accounts get deleted, taking the evidence with them. Secure the file on the day you decide to act.

  1. Full-page screenshots of the review with the business name, reviewer name, rating, date and URL visible.
  2. Notarised or timestamped copies. In Türkiye a notary can issue a determination record (tespit) of a web page; in Germany and Austria lawyers use a notarial record or a qualified timestamp service. A reviewer who disputes the authenticity of plain screenshots can delay the case by months.
  3. The reviewer profile: every other review, join date, photos. The same text under five businesses is the core of a fake-engagement case.
  4. Your records: booking, invoice, POS and CCTV extracts for the claimed period, proving that the person was not a customer or that the asserted fact is false.
  5. Report history and damage evidence: Google decision dates, rating before and after, cancellations that mention the review.

Court orders in Germany and Austria: the duty to investigate

German and Austrian law offer the strongest tools in Europe against reviews with no real customer contact behind them.

The 2022 BGH ruling

In August 2022 the German Federal Court of Justice (BGH, VI ZR 1244/20) ruled, in a case about hotel reviews on a rating portal, that when a business plausibly disputes that the reviewer was ever a customer, the platform must forward the complaint to the reviewer, ask for evidence of the contact, and delete the review if the reviewer stays silent or cannot substantiate it. German courts apply this to Google, and Austrian courts reach similar results through § 1330 ABGB, which protects honour and economic reputation against untrue statements of fact.

From notice to injunction

A lawyer sends a formal notice to Google Ireland Ltd., stating that the reviewer was not a customer or that the factual assertion is false, citing the ruling and demanding deletion within one to two weeks. Google contacts the reviewer; if no proof arrives, the review is deleted, usually two to six weeks after the notice. If Google refuses, the lawyer applies for an interim injunction (einstweilige Verfügung), which can be granted within days to a few weeks because reputation damage is treated as urgent. Costs are largely recoverable if you win; losing means paying both sides. Suing the reviewer directly requires a disclosure order first (§ 21 TDDDG in Germany), which adds months.

GDPR Article 17: the right to erasure for personal data in reviews

The GDPR right to erasure is widely misunderstood as a delete button for reviews. It is not. Article 17 gives a natural person the right to have their personal data erased when there is no overriding lawful basis for keeping it; a company has no personal data and no Article 17 right over reviews of the company. Where it does apply:

  • An employee named in a review with accusations or insults (“Dr. Berger at Nordlicht Dental is a butcher”). The employee, not the clinic, files the request.
  • A sole trader or professional whose name is the business name: lawyers, doctors, architects.
  • Reviews disclosing private data: a home address, a phone number, health details.

The request goes to Google through its personal data removal form, citing Article 17. Google must respond within one month (Article 12), extendable by two months in complex cases, and weighs the request against the reviewer’s freedom of expression (Article 17(3)(a)). Requests about a professional’s performance often lose that balance; requests about insults, private details and false accusations against a named person often win. If Google refuses, a complaint to a data protection authority is free.

Türkiye: Law 5651 and the Criminal Judgeship of Peace

The home market of yorumkaldir.com has one of the fastest statutory procedures anywhere for content that violates personal rights. Under Article 9 of Law No. 5651, a person or company whose personality rights are violated by online content can apply to the content or hosting provider, which must answer within 24 hours, or go directly to the Criminal Judgeship of Peace (sulh ceza hakimliği). The judge decides without a hearing, by law within 24 hours, and can order removal of the content or blocking of the specific URL. The decision goes to the Access Providers Association for enforcement, and since the 2020 amendment large social network providers, Google among them, keep a local representative and must act on Article 9 applications within 48 hours.

In practice a lawyer files the application with the notarised screenshots and the business records; a decision typically arrives within days, and Google then removes or geo-restricts the review for users in Türkiye. Insults can also be pursued as a criminal complaint for hakaret (Article 125 of the Turkish Penal Code). Two cautions: content restricted under a Turkish order may remain visible abroad, and an ordinary negative opinion will be rejected by the judge.

How yorumkaldir.com supports both routes

yorumkaldir.com is not a law firm and does not give legal advice. It runs the policy route to its end and hands over a clean file when the law has to take over.

  • Policy route, no prepayment. Analysts review every 1–3 star review with text or photos against Google’s policies, file through the official tool, appeal once with evidence, and track each case in a live report link. You pay per review only after it is removed; reviews from the last 25 days carry a 100% guarantee. Bank transfer earns a 5% discount, card payment carries a 5% fee.
  • Evidence pack for your lawyer. Timestamped screenshots, reviewer profile analysis, cluster timeline and the full report history with decision dates, exported from the live report.
  • Afterwards. Removed reviews are watched for 30 days and Business Watch flags returning harassers inside the guarantee window. Law firms can run the policy route for clients through the reseller program.

Marina Lounge Café is a typical sequence. A former partner posted eleven reviews calling the owner a fraudster and naming her home street. Nine were removed through harassment and personal-information reports within two weeks; for the two oldest, rewritten as vague opinions, the owner’s lawyer used the evidence pack to obtain a Law 5651 decision in eight days. The café paid for nine removed reviews, after removal, and nothing for the two.

Find out which route your reviews need. Create a free account and run a free scan of your Google profile: every 1–3 star review with text or photos is listed with the likely policy category, and reviews that look like a legal case are flagged. No prepayment; the full process is on the how it works page.

Frequently Asked Questions

What is the difference between a negative review and a defamatory one?

A negative review expresses an opinion about a real experience (“the room was dirty”). A defamatory review asserts a false fact that damages reputation (“the owner was convicted of fraud”) or attacks a person with insults and threats. Only the second kind can be challenged legally; the first can only be answered.

Should I go to court before reporting the review to Google?

No. Always report through Google Business Profile first: it is free, takes 3–21 days, and removes most harassment and personal-data reviews. Legal routes are for reviews that Google keeps online despite a clear factual falsehood or personal attack.

Can GDPR force Google to delete a review?

Only where the review contains personal data of a natural person, such as an employee’s name combined with accusations. Article 17 does not cover opinions about a company, and Google balances every request against freedom of expression. Google must answer within one month.

What did the German BGH decide about Google reviews?

In 2022 the Federal Court of Justice held that when a business plausibly disputes that the reviewer was ever a customer, the platform must forward the complaint to the reviewer and ask for evidence of the contact. If none is provided, the review has to be deleted.

Does yorumkaldir.com provide legal services?

No. yorumkaldir.com handles the Google policy route with no prepayment and a fee only per removed review, and prepares the evidence pack (timestamped screenshots, profile analysis, report history) for your lawyer when a legal route is needed. Legal outcomes are never guaranteed.
